1. Acceptance of Terms

By accessing or using the Fireworks Display Crate website at fireworkscrate.com ("Site") or purchasing any products or services from Fireworks Display Crate ("FDC," "we," "us," or "our"), you ("User," "you," or "Customer") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site or purchase our products.

2. About Our Products and Services

Fireworks Display Crate provides complete professional fireworks display systems ("Show Kits") designed for communities, municipalities, and authorized organizations. Each Show Kit includes UN0431 Articles Pyrotechnic 1.4G products (professional display effects), the COBRA wireless firing system (customer-owned or rented through FDC), electric igniters, numbered firing templates, a site layout map, and a setup and safety guide.

3. Eligibility and Authorized Users

Our products and services are intended exclusively for municipalities, community organizations, and other entities authorized by the relevant Authority Having Jurisdiction ("AHJ") to conduct public fireworks displays. By placing a reservation or purchasing a Show Kit, you represent and warrant that:

• You are at least 18 years of age;
• You are acting on behalf of an authorized municipality, community organization, or AHJ-approved entity;
• You have obtained all local and state permits required to conduct a public fireworks display in your jurisdiction;
• You have the authority to bind the organization you represent to these Terms.

FDC reserves the right to refuse service to any individual or organization that does not meet these eligibility requirements.

4. BATFE / Federal Explosives Licensing — Conditions and Limitations

Our Show Kits contain UN0431 Articles Pyrotechnic 1.4G products. Under applicable federal regulations, a BATFE (Bureau of Alcohol, Tobacco, Firearms and Explosives) federal explosives license is generally not required for municipalities and AHJ-authorized organizations to purchase these products for authorized public display use. However:

• This exemption does not eliminate obligations under state, county, or local law;
• It is your sole responsibility to determine what permits, licenses, and approvals are required in your jurisdiction;
• FDC makes no warranty or guarantee that any specific jurisdiction will permit the use of our products without additional licensing or approvals;
• FDC is not liable for any penalties, fines, or legal consequences arising from your failure to obtain required permits or comply with applicable laws.

5. Reservations and Payments

Reservation Fees. A non-refundable reservation fee ($99–$399 depending on show size) is required to secure your slot. Reservation fees lock in availability and are credited toward the full purchase price.

Full Purchase Price. The balance of the full purchase price is due as specified in your Show Contract. Failure to complete payment may result in forfeiture of your reservation fee and cancellation of your order.

Pricing. All prices are listed in U.S. dollars and are subject to change without notice. Reserved pricing is honored as of the date of reservation.

Taxes. You are responsible for all applicable sales, use, or excise taxes imposed by your jurisdiction.

6. Show Profile and Contract

After reservation, you must log in and complete a Show Profile consisting of event details, COBRA system selection (customer-owned or rental), licensing documentation, tax information, and a signed Show Contract. Your order will not be processed or shipped until all profile steps are completed and your Show Contract is executed. The Show Contract is incorporated into and forms part of these Terms.

7. Shipping and Delivery

FDC will ship your Show Kit to the address provided in your Show Profile. You are responsible for ensuring that someone authorized to receive hazardous materials is available at the delivery location. Shipping timelines are estimates and are not guaranteed. Risk of loss transfers to you upon delivery.

8. Safe Use and Your Responsibilities

You assume full responsibility for the safe storage, handling, setup, and firing of all fireworks and equipment included in your Show Kit. You agree to:

• Read and follow all instructions in the Setup & Safety Guide included with your crate;
• Adhere to all applicable federal, state, and local safety regulations;
• Establish appropriate safety perimeters as specified in the Site Layout Map;
• Ensure that only trained, responsible adults operate the COBRA firing system;
• Never use our products in a manner inconsistent with their intended purpose or in violation of any law.

9. COBRA System

The COBRA wireless firing system supplied in connection with your Show Kit—whether you use your own unit or rent through FDC—is subject to COBRA Systems' own terms, conditions, and licensing agreements. Use of the COBRA system constitutes your acceptance of those terms. FDC is not responsible for the performance or malfunction of third-party equipment.

10. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of FDC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.

11. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FDC SPECIFICALLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FDC, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, YOUR PURCHASE, OR YOUR USE OF ANY SHOW KIT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL FDC's TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FDC FOR THE APPLICABLE ORDER.

13. Indemnification

You agree to indemnify, defend, and hold harmless FDC, its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or any Show Kit; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any fireworks display you conduct using our products.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of our products shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association, with proceedings conducted in Wichita, Kansas. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

15. Modifications to These Terms

FDC reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or our services after any such changes constitutes your acceptance of the revised Terms.
